The Kub Club is jointly owned and run by Bianca Smith and Zoe Cole. The operational premises is rented and overseen by St Michaels Church at 112 Clarendon Road, Ashford, TW15 2QD.
These terms and conditions will refer to “we” or “our” with reference to "The Kub Club".
You may be considering attending a play session with us or have recently booked in, here are the terms and conditions which will be relevant for you. We recommend you carefully read all terms and conditions carefully before accepting. If you do not agree with the the following terms and conditions you can not attend our classes or sessions under any circumstances. Once you have attended, if you are unhappy any aspect of your play experience, please get in touch with our team at info@thekubclub.co.uk. These terms and conditions apply to everyone who wishes to use our website or attend one of our sessions either booking online or in person. By booking online or in person you agree to the following terms and conditions:
General Sessions
- Our sessions are suitable for 0 years up to a child’s 5th birthday.
- All our sessions are delivered by The Kub Club leaders and are representatives of The Kub Club. Each session will likely be different content which is set in advance. We are constantly adapting and changing to provide the best possible experience for yourself and your child.
- Our general sessions are parent and child led sessions; which means the parent or guardian in attendance has full responsibility for their child’s safety. Your child is your sole responsibility at all times. Our play sessions are not risk free activities and therefore you will remain responsible for assessing an potential risks and ensure no harm comes to your child. We for not assume any liability for an harm or injury suffered to you or child at any of our sessions. Whilst we attempt to ensure the complete safety of our visitors it is the responsibility of parent(s) or guardian(s) to supervise children in the session with a ratio of 1 adult for every 3 children under 5 (except for Childminders). The parent(s) or guardian(s) must always remain within the building, observe their children to ensure that they are capable of using the equipment safely, explain the rules of play to the children, monitor their behaviour and know where their child is.
- We ask you do not attend any sessions if yourself, your child or anyone in your household is feeling unwell with vomiting and diarrhea. The session leader has the right to turn you away from attending the session if they believe you or your child to be any cause of concern in terms of illness spreading of contagious illnesses such as but not limited to COVID-19.
- You agree to adhere to the play sessions rules (displayed in the hall):
shoes off, socks on
no food or drink in the play zones
adult supervision is required at all times (this does not include a Kub Club representative)
be mindful of each other and our equipment
- If the sessions are cancelled we will organise the refund or rebooking of your entry fees. This includes but if not limited to cancellation for illness, injury, dangerous conditions beyond our control.
- Strictly no smoking/vaping on the premises, which includes the patio area at the front of the church hall.
- In the interest of Health and Safety, please ensure that any food debris which falls on the floor is picked up/wiped up as soon as possible, either by the parent or guardian or by a Kub Club representative.
- Parent(s) or guardian(s) must ensure that the toiletry needs of children in their care are always looked after during the sessions. Nappy changing must be conducted in the baby changing area in the allocated Kub Cub toilet. Please discard nappies and used products in the correct bins provided and clean after yourself. Failure to do so may incur a cost for cleaning, any damage to the play equipment and loss of business.
- We operate a zero tolerance rule for bad/abusive behaviour towards staff and between customers within our sessions, from any person. Unacceptable behaviour will result in being asked to leave the session immediately and a possible permanent ban.
- You, as the parent or guardian attending with their child, must be over 18 years to accept these terms and conditions. By booking or attending our sessions you confirm you are over 18 and have sufficient capacity to accept and abide by these terms and conditions.
- Here at The Kub Club we understand circumstances may change especially when involving young children and babies. With this in mind we try our best to accommodate all our customers in a range of circumstances; each request for refund will be considered carefully. Online bookings will be refunded if cancelled within 5 days of booking date. If the booking is made on the same day, you will not receive a refund. If you need to cancel on the day of your booked session, it is possible to transfer your purchase to another day.
Emergency Evacuation
In an event of an emergency, all people must collect their child and vacate the church hall using one of the clearly marked designated exits. You are solely responsible for your own safety and the safety of the child(ren) in your care. Kub Club representative(s) will be on hand to coordinate the procedure and liase with emergency services where appropriate.
Equipment
All equipment is checked when being put away or being set out. If any piece of equipment is deemed unsafe, it will not be used. If the equipment becomes unsafe during an open session, please inform a Kub Club representative immediately. Equipment is cleaned on a rotational basis; smaller items can be separated for a 'deep' clean by using the 'yuck bucket'.
Parking
There is a small carpark at the rear of the church. The car parking bays are intended for use by anyone attending an event at the church, however, there are some designated sign posted parking bays that are strictly reserved for the use of the church.
Personal Information
We require basic information for our online booking system and party bookings which are GDPR compliant. We will not pass on your information to any third parties. We will only use this information to identify yourself and child upon attending the sessions. Your information is protected under the Data Protection Act 1998 and the European Union General Data Protection Regulations.
Photographs
We take pictures at some of our sessions to use for promotional uses in a variety of formats such as social media, our website and flyers plus more. If yourself or your child is featured in any pictures we will ask to you for written permission or ask you to sign a consent form. All our images are stored securely. If you wish for us not to take photos we will need this to be confirmed my yourselves in writing prior to attending our sessions by emailing us at info@thekubclub.co.uk. If you choose to take photos during our sessions, we ask that you do NOT include the face(s) of any other children (without their parents permission). If you choose to post your photographs on social media, again we ask that you only use photos of the child(ren) that you are responsible for.
Allergies
It is your responsibility to inform us of as allergies that yourself or your child has (either via email, online form or in person on arrival). If we do not hear from you beforehand we will assume you and your child do not have any allergies. The Kub Club are not liable (other than through our own negligence) for any injury or illness caused to your children as a result of them having an allergic reaction to any material or ingredients used in our sessions if you have not provided the relevant and sufficient information to our team BEFORE attending the session. Please provide all allergy information to our team at info@thekubclub.co.uk. We will not be liable or responsible for any failure to perform or for the delay in performance of any of our obligations under the above terms that is caused by events that are beyond our control.
Website
Our website description are a guideline and may alter to session content when you attend. You also need to be aware that viruses can be transmitted via websites, not just email. If you want to make sure that your systems are safe from infection, you should run suitable security software because we hereby exclude liability for any virus infection or other harm caused to your systems through your use of our website, or when following any links to websites run by other people.
If we happen to make a statement that turns out to be untrue (whether orally or in writing) prior to your booking, then, unless that statement was made fraudulently by us, we will only be liable to you should that untrue statement result in us breaching these Terms. If it does not, the untrue statement has no impact on our relationship with you save insofar as it may impact on your legal rights as a consumer.
There may come occasions where we choose not to insist on your total compliance with your obligations under these Terms or that, where you’ve breached the Terms, we don’t make use of our rights to take action against you. This does NOT mean, however, that we are waiving those rights. We can take action against you later if we so choose, and at any time during a booking period (or indeed, where necessary, at any time after your booking), we can return to the issue and insist upon your compliance.
Party Hire/Bookings
These terms and conditions will refer to “The Party Organiser" with reference to the adult under whom the booking has been made.
- A provisional booking can be made in person, by telephone, via social media (Instagram or Facebook) or via our website enquiry page. A provisional booking does not in any way confirm a party as booked. A Kub Club representative will confirm the availability of your chosen date and time and will provisionally hold the slot for a maximum of 5 days. A non-refundable deposit (of £60) will be required at the time of booking along with a complete Party Booking Information sheet. The party deposit will be refunded if the party is cancelled within 14 days of the receipt of the payment (cooling off period). Should a deposit not be paid within the specified time we reserve the right to cancel your booking and reallocate your slot. Any payments made over and above the minimum deposit will be treated as deposit monies and are refundable.
- Please note the recommended number of children required for a party package is 20. Additional children will incur additional cost. Maximum number of children is 25. The number of adults staying at the party is managed by The Party Organiser.
- The Party Organiser must supervise children attending the party at all time.
- In the event of first aid requirement, The Party Organiser must alert a Kub Club representative.
- Where hall hire is provided (Package 1), The Party Organiser can bring their own food. Further to the introduction of Natasha's Law it is the responsibility of The Party Organisers to inform their guests of the ingredients and allergen information on any allergies or intolerances for the party attendees; this is the sole responsibility of The Party Organiser.
- The hall is required to be left in a clean and hygienic condition after use. We will tidy away all equipment into the allocated storage facility. General cleanliness will also be The Party Organiser responsibility.
- If the party includes a celebratory cake, The Party Organiser is responsible for the cutting of the cake and the lighting, disposing and handling of candles.
- It is the responsibility of The Party Organiser to obtain permission from parent(s) or guardian(s) of children attending the party if photography/video is taken.
- We recommend that The Party Organiser obtains emergency contact numbers for all the children who attend their party.
- Balance payments are due 7 days before the date of your party and the number of guests have been confirmed. An email will be sent requesting the outstanding balance 14 days before the date of the party.

This concludes our terms and conditions. As soon as you have completed your booking through our website or paid entry in person you will have a binding contract with us.
